Lawyer: Driver was asleep before crash

A tractor-trailer driver fell asleep at the wheel because of a medical condition before hitting a North Carolina Highway Patrol car and instantly killing the trooper inside, the truck driver's lawyer said.
The truck driver suffers from sleep apnea, a disorder that can cause drowsiness during the day, his attorney said Wednesday, the first day of testimony in the second-degree murder trial. The driver was diagnosed with the illness after the crash.
The crash happened May 30th on Interstate 40 near the Tennessee state line while the trooper was parked on the side of the road for a traffic stop.
"He fell asleep." his lawyer told the jury. "He could do nothing to stop it. He just held on and prayed."
Two witnesses said the truck was swerving before the crash. A wheel scraped a guardrail for 89 feet before the rig hit the troopers car. The truck pushed the patrol car 500 feet to the other side of the highway, where it burst into flames.
